Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Amory Apps Corp (“Moonie,” “we,” “us,” or “our”) governing your use of the Moonie mobile application, our onboarding quiz, our websites, and related services (collectively, the “Service”).

Please read these Terms carefully. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for parents and caregivers located in the United States. By using the Service, you represent that you meet these requirements.

2. What Moonie Is — and What It Is Not

Moonie provides general, educational, evidence-informed content about infant and toddler sleep, including lessons, articles, and a personalized sleep plan based on the information you provide.

Moonie is not a medical service. The Service does not provide medical advice, diagnosis, or treatment, and using it does not create a doctor-patient or other professional relationship. Our content is not a substitute for professional advice from your pediatrician or other qualified healthcare provider.

Medical and Safety Disclaimer

• Always seek the advice of your pediatrician or another qualified health provider with any questions about your baby’s health, sleep, feeding, or development.
• Never disregard or delay professional medical advice because of something you read or saw in the Service.
• If you think your child may have a medical emergency, call your doctor or 911 immediately.
• Follow current safe-sleep guidance from your pediatrician and recognized public-health authorities. Moonie does not replace that guidance, and you are solely responsible for your child’s sleep environment and safety.
• Every baby is different. Educational content and personalized plans describe general approaches and what tends to work for many families; they are not guarantees of any particular outcome, and individual results vary.

You acknowledge that you use the Service and any sleep plan at your own discretion and risk, and that you remain fully responsible for decisions about your child.

3. Your Account

To use certain features you may need to create an account. You agree to provide accurate information, keep it current, and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions, Billing, and Auto-Renewal

Moonie offers paid subscriptions that unlock the full personalized plan and content library. The following terms apply to all subscriptions.

4.1 Pricing and Payment

Subscriptions are sold and billed by Amory Apps Corp through our checkout, using our third-party payment processor. You may pay using Apple Pay or another supported payment method. Payment is charged when you confirm your purchase. The price, billing period, and any introductory or trial terms are shown to you on the purchase screen before you buy. All prices are in U.S. dollars (USD). We do not store your full payment card number — it is handled by our payment processor.

4.2 Auto-Renewal

Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. At renewal, your payment method is charged the then-current standard price for the next period. You authorize us to charge that amount until you cancel.

4.3 Plans

The current plans, including any introductory or trial pricing and the standard price each plan renews at, are as follows. (Prices in USD; the amounts below reflect the offers shown on the purchase screen at the time of purchase.)

• 7-Day Trial — introductory price of $6.99, which converts to a $39.99 / month auto-renewing subscription unless canceled.
• 1-Month Plan — introductory price of $14.99, which converts to a $39.99 / month auto-renewing subscription unless canceled.
• 3-Month Plan — introductory price of $29.99, which converts to a $79.99 / 3 months auto-renewing subscription unless canceled.

The price disclosure shown on the paywall at the time of purchase must match these amounts exactly.

4.4 Canceling

You can cancel your subscription at any time:

• In the app under Settings, or
• By emailing us at support@mooniesleep.com.

To avoid being charged for the next period, cancel before the current period’s renewal date. Canceling stops future renewals; you keep access until the end of the period you have already paid for. Deleting the app does not cancel your subscription.

4.5 Refunds and Money-Back Guarantee

Except as required by law or as expressly provided by our money-back guarantee below, payments are non-refundable and there are no refunds or credits for partial billing periods.

Money-Back Guarantee. We offer a money-back guarantee for users who give the program a fair try and do not see results. To be eligible, you must:

1. Have actively used the app for at least 30 days, and
2. Have followed your personalized sleep plan during that period and still not achieved meaningful results.

To request a refund under the guarantee, email support@mooniesleep.com within 14 days after the end of that 30-day period. We may ask you for information showing your use of the app and the plan. Approved refunds are issued to your original payment method. This guarantee applies to the amount you paid us directly and does not extend the auto-renewal or waive Section 4.4.

4.6 Price Changes

We may change subscription prices. If a price change applies to your renewal, we will notify you in advance as required by law, and continued use after the change takes effect constitutes acceptance of the new price. You can cancel before renewal if you do not agree.

5. License to Use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on devices you own or control, for your own personal, non-commercial use. We reserve all rights not expressly granted.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Copy, reproduce, distribute, resell, or publicly display our content except as expressly allowed;
• Reverse engineer, decompile, or attempt to extract source code, except where the law prohibits this restriction;
• Circumvent paywalls, access controls, or usage limits;
• Upload malware or interfere with the operation or security of the Service;
• Use bots, scrapers, or automated means to access the Service;
• Misrepresent your identity or impersonate others.

7. Intellectual Property

The Service and all of its content — including text, lessons, articles, the personalized plan methodology, graphics, logos, the Moonie name and marks, UI, and software — are owned by Amory Apps Corp or our licensors and are protected by intellectual property laws. You receive no ownership rights. You may not use our trademarks without our prior written permission.

8. Your Content and Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us a worldwide, royalty-free, perpetual license to use them without restriction or compensation. Any information you enter about your baby remains yours; we use it only as described in the Privacy Policy.

9. Third-Party Services

The Service relies on and may link to third-party services (such as app stores, payment processors, and analytics providers). We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

10. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation, except as required by law or for refunds owed for prepaid subscriptions where applicable.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SLEEP PLAN OR CONTENT WILL PRODUCE PARTICULAR RESULTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMORY APPS CORP AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Amory Apps Corp from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason permitted by law. You may stop using the Service at any time and delete your account. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Governing Law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws principles.

16. Dispute Resolution; Arbitration; Class-Action Waiver

Except for (a) qualifying claims in small-claims court and (b) claims to protect intellectual property, you and Moonie agree to resolve any dispute relating to these Terms or the Service through binding individual arbitration, and you waive the right to a jury trial and to participate in any class or representative action.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted on an individual basis, in the State of Delaware or by remote means. The arbitrator decides all issues, except that a court decides the enforceability of this class-action waiver.

30-Day Opt-Out. You may opt out of this arbitration agreement by emailing support@mooniesleep.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

17. App Store Terms

The Moonie app is distributed through the Apple App Store and/or Google Play. You agree to comply with the applicable app store’s terms. If you obtained the app from the Apple App Store, you acknowledge:

• These Terms are between you and Amory Apps Corp only, not Apple, and Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

(Subscriptions are billed by Amory Apps Corp through our own checkout, not through Apple or Google in-app purchase; refunds and cancellation are handled by us as described in Section 4.)

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email and update the “Last Updated” date. Your continued use of the Service after the changes take effect means you accept the updated Terms.
